Legal Question in Civil Litigation in Virginia

Internet Harassment

I am being harassed by an ex-internet friend. We both sell the same types of items on an auction site. This person is trying to eliminate me (her competition). She is reporting me for things I have not done to the site. Basically she is sending false reports constantly. She has had friends & other buyers try to trap me into violating the websites polices. I have an email from a third party stating that she is trying to have me removed from the site. She has recently filed a flase police report in her home town of Norflok to accuse me of harassment. Their dept of decetives have not taken the case because they dont find evedence or merrit in it. Now, she's taken the case # to her clerk of court & gotten subpeonas to review my emails. Which is fine because I have nothing to hide. This is harassment & Im losing sleep over this. I believe she's going to file a frivilous lawsuit in Norfolk Va that I cannot attend because I live in Fl. She knows this & that's why she's doing this. It's just harassment. How can I stop this.

Re: Internet Harassment

If a lawsuit is filed against you, you may wish to consider filing a counterclaim if you have identifiable damages and to retain Virginia counsel to represent you in the matter.

If you know she is going to sue you in VA, then you might have a basis for suing her in FL first, possibly under a FL statute relating to Internet harassment. Make a record of you objections to her behavior with your site and keep all evidence. You really should consult with an attorney familiar with this area of the law to try to get ahead of her game.

I focus on Internet related matters.
