Rear ended by 18Wheeler

Hi Lawyer Friends! I have 2 questions....

1. Is it a car or a driver that is normally insured?

2. I was recently rear-ended by an 18 wheeler (on I-95) who is now claiming that I reversed into him (are you kidding me?) I have 3 witnesses in my car and pictures after incident. we did not involve police. I am hoping that VA has a law where the person who does the rearending is not at fault (I hear some states do). Do you know if this is true or do you have any advice for me?

The driver rather than the car is normally the insured. Unless you braked suddenly and unreasonably, the

18 wheeler should be liable for following too closely.
