Legal Question in Employment Law in Virginia

Employer failure to pay

My employer has not payed anyone in the office for two months. Excuses are we are trying to get a loan to cover payrole, and we have to sell some assets. But they really aren't telling us anything.

Are we stupid to stick around. One of the unpaid accountant gave up when she was instructed to make the payment on the CEO yacht and the country club payment. Is the boss doing anything illegal by not making our status clear. It seems we have been layed off already. We we keep coming to work in hopes of getting paid. It involves six employees.

Re: Employer failure to pay

You should very likely not expect any compensation any time soon from this employer and, consequently, you're likely better off cutting your losses sooner rather than later. In the meantime, you could file a complaint with the Wage and Hour section of the Labor and Employment Division of the Virginia Department of Labor & Industry(VDLI).(You may be able to do it online.)

You may also wish to consider filing an

action in small claims court if the company continues in its refusal to pay you the compensation which you've earned.
