Legal Question in Medical Malpractice in Virginia

Autopsy requested

My son died and I was asked by the Er physician if I wanted an autopsy performed. I said ''yes''. We have just found out that it was never performed. Can we blame the hospital? Where should we begin?

First you should find out the hospital's reason(s) for not performing the autopsy. You should also secure all of your son's medical records from this hospital to be reviewed by an independent person who is competent to determine whether there is any culpability on the part of this hospital staff and/or doctors for your son's death.

It is possible. However, it all depends on how your son died. Did he die under circumstances where an autopsy was required? If not then there may be some cause of action. If not then I am not sure that there would be.
