Medical Misdiagnosis

My father presented at the hospital last Thursday with stroke-like symptoms. He was diagnosed with dehydration and a viral infection, although he had no fever. He was given an IV and valium for dizziness. He was admitted to the hospital today with a mild stroke, resulting in limited right-side mobility. Is this misdiagnosis actionable?
