What is the statute of limitations in filing a wrongful death suit against a cardiologist in Virginia? It will be 3 years in January since my husband died from a fatal cardiac arrythmia. His doctor knew he had the erratic heart beat and had tried to correct it months earlier during a hospitalization using medicine. It did not work. I have recently learned that a pacemaker could have saved my husband's life and that the doctor should have had this implanted because of the severity of my husband's erratic heart beat. He left behind a 5-year-old and 14-year-old son. He was only 52 years old.

I regret to learn of your disheartening news concerning your deceased husband. I also regret to inform you that the applicable statutes of limitations for the causes of action that would be implicated in your inquiry, namely, medical malpractice/wrongful death are likely two years from the date of his unfortunate (and not to mention premature) demise.
