Legal Question in Personal Injury in Virginia

Is a business required to carry insurance coverage for injuries that happen o

I was helping to clean up after a skate show, and I fell causing a fracture to my elbow. I did not have skates on. My husband had just started a new job and had not been working long enough for his insurance to cover the injury. The skating rink where I fell said their insurance did not cover it either. I just want to know if they are being truthful with me. Legally is then anything I can do? I could sure use help with the medical bills.

Re: Is a business required to carry insurance coverage for injuries that happ

In general, a business is not required to carry liability or medical expense coverage, but it is usually foolish not to carry liability coverage. The rink probably meant they do not have no-fault med pay coverage, which pays for medical expenses for injuries on a business premises without regard to fault. This would be very expensive for a skating rink if available at all, and it is unnecessary because it pays where the uninsured business would have no obligation to pay. The rink probably does have liability insurance which would defend and indemnify it for claims resulting from its negligence or fault. If you fell because of your own fault, you cannot recover, but if your fall was due to the rink's negligence with no fault of your own, you may have a claim (and should see a lawyer).
