There is a 2 year Statute of Limitations within which a lawsuit must be filed with a court (assuming this to be an accident which occureing within the Commonwealth of Virginia). The fact that there is no mention of any injury for some period of time is only evidence going to the severity of the injury or its causation as the result of the accident

Assuming the accident occurred in Virginia, you have two years within which to file suit.
