Daycare providers negligence

My son was severly scratched all over the face by another child at his daycare, there were more than 18 large, small and deep scratches on his little face. If the daycare provider was doing her job and watching the children this wouldn't have been as severe. When she called me at work, she said that he was upset, nothing more. She didn't notify me of what happened, she didn't tell my mother what happened when she went to pick up my son. My mother had to ask her what had happened. In the daycare providers words ''I can't watch them all of them time..'' What was I paying her for?! I took my son out that same day. I was supposed to give a two week notice, but I feel she doesn't deserve a notice since she didn't notify me, or my mother or my son's father that my child had been injured. She told us, it's not about the money...I recieved summons from the court of her suing me for the two week notice. Please help!!!

If she were not already suing you I would advise to let it go but in this case you may want to consider a counter claim. There are various different legal theories you could pursue the day care center owner under. Speak with an attorney about this matter.
