I was in a car accident in January of '07. The other driver claimed responsibilty for the accident. I had a prexisting low back condition, but the accident caused another disc rupture. I had an MRI in 06 and another on 9/07. The Ortho stated the L4/5 rupture was not there on the earlier MRI. Since the accident I have had 2 epidurals, 4 trigger point injections, 3 PT visits and I have to do exercises daily. My Ortho said I have an option for surgery. Not disc replacement, just trimming the ''new'' rupture. My question: How much should I expect to receive in a settlement...with and with without the surgery? Hoe long will it take to settle?

It's not really possible to evaluate a case without going over all of the facts with a client, including a review of the medical records and bills, the facts of the accident, the available venues for suit and jury verdicts there, the insurance situation, and other facts and circumstances. The existence of a prior injury complicates matters. You should see a lawyer, as I can almost guarantee that even after paying a contingent fee to a lawyer, you will come out better than trying to do this yourself.
