Legal Question in Personal Injury in Virginia

I was hit in a shopping center parking lot on my drivers side front tire and bumper, while their front drivers head light was broken. He said he pulled his emergency brake but didn't see me in time but one would have to take the time to pull the emergency brake. I can take the blame for my part by driving through the parking spot but It seems as thought the driver in the other car needs to take his blame for going faster than he should have because he hit me so hard that my tire was bent in and I was unable to drive it...Can you tell me what I can do?

What might be called a "he said vs. he said " situation, is it? You could sue

or reach a settlement with this other driver that would avoid involving insurance claims by simply agreeing to split the total costs of repairing the two vehicles or something similar to this arrangement.
