Legal Question in Personal Injury in Virginia

Injury in a community riding ring

I am part of a homeowner's association with common ground including a equestrian riding ring. A 3rd party, non-homeowner was taking lessons on another homeowners horse and was recently injured on riding on community property. Can this person sue the homeowner's association? Our fear is that b/c ours is a community of several homes we'll be seen as the deep pockets in this circumstance.

Re: Injury in a community riding ring

You can sue anybody, the question is whether there is liability on the part of the homeowner's association. What was the cause of the injury? Was there notice of any defect? Was there any waiver of liability signed? Too many unknowns to comment on the HOA's vulnerability at this point.
