Legal Question in Personal Injury in Virginia

Punched in mouth, teeth knocked out

My girlfriend recieved a call from her ex-boyfriend one night when we were hanging out at my parents house with a couple friends. One of my friends picked up the phone but said nothing hurtful or threatening. The ex-boyfriend was drunk and assumed that it was me on the phone and stated that he was coming over to my house and that I'd better be outside. I stayed inside while my friend and my girlfriend waited inside. As soon as he showed up (with two buddys) I got on the phone with the cops. After giving the cops my address, I continued to warn them that the cops were on the way. I asked the cops if I should get the liscense plate #, so I walked towards the car. On the way to the car the ex-boyfriend sucker punched me in the mouth without me doing anything. He knocked out one of my front teeth, broke my retainer (with two false teeth from a previous accident) and pushed back two lower teeth. I went inside. I pushed the two lower teeth back forward, and immediately ripped out the half broken front tooth. I am waiting to see if I have root damage to two teeth on the front. But I was wondering if I can get restitution for the damages he has caused me. I dont know his financial status. He is 21, and is in jail for other charges.I am 21

You should ensure that criminal charges for assault and battery against your person are filed against this purveyor of mayhem and injury(if you have not already done so).

You can also sue him in civil small claims court for up to $5000 for damages which you have incurred as a result of this assault and battery.
