security deposits

I have had the same apartment since 10/2003 and had taken the apartment in a less than suitable condition, upon moving in 10/2007 i had received a refund of my security deposit of only $204 when it should have been $990 or more! There was an itemized list, including $600 for paint, and other thing that totaled $693, I did the math and it doesn't add up, The current landlord had subsequently made a phone call to my how a cannot account for the missing money or any monies owed in interest. the former landlord has a copy of the contract and says that it states all the problems we are getting charged for are preexisting conditions and that the new landlord has no ''legs'' to stand on. the new landlord also insinuates that because we smoked in the apartment that we remain responsible for the painting, but i could tell that when we moved in there wasn't any painting done any time before we moved in. His nonchalant attitude coupled with his lack of knowledge upon request of more information into the charges has my distressed and worried that my and my family are getting taken to the cleaners, i have 3 small kids and i just want what is owed so i can give them a good Christmas. someone help

If you believe that your security deposit has been unfairly charged by this new landlord who now refuses to make any aceptable adjustment in what he has withheld, your remedy is to file suit in small claims court.
