Personal Items Sold while Repairing

Took a watch family heirloom in to be repaired. Owner sold watch to another customer. Employee watched transaction. Owner leaves country. Want to sue other customer for watch. Whose legally entitled to the watch?

It is unclear to me what government entity or entity acting with government authority is involved in this matter or specific right was violated that is protected under a civil rights statute. This looks more like a tort case.
