Legal Question in Medical Malpractice in Washington
Counselor encouraged illegal behavior
My wife and I are legally separated, but we have been seeing counsellors to resolve our disputes (and hopefully, reconcile). Each of sees this particular counselor on an individual basis.
My stated goal to this counselor was NOT to seek treatment for myself, but to make myself available as a resource in order to properly diagnose my wife. (In my opinion, my wife has a mental or medical condition that makes her extremely volatile and very angry a great deal of the time.)
I am no longer seeing this counselor, because I found out that she was encouraging my wife to tape record my conversations with my 3 year old son. I doubt that she actually told my wife to record my conversations, but the counselor told me that she listened to a great many of them, which I believe encourages my wife to keep on recording them.
I believe this to be unethical, as well as illegal. Do I have any legal recourse to recover damages in what is now an irreconcilable situation? Is this the right question to be asking?

The electronic interception [as by taping] of communications without the consent of the participants in a crime in many jurisdictions. You should consult a lawyer in your locale to determine wether in your state such conduct is illegal. Such a lawyer can also advise you concerning what other rights you may have.
