Legal Question in Personal Injury in Washington

Pre-settlement

My friend is a man in his 60s, he was in a cross walk, in his three wheel scooter when the driver of an auto hit him and knocked him out of the cross walk destroyed the scooter.

He is still feeling the effects from this. His attorney is uncomfertable with asking for a LARGE settlement (500k)for fear of loosing credability with the insurance adjuster, I'm still scratching my head over this. Is there an amout to use as a guild? The attorney has also said the insurance policy max is all that he can go for but he does not know what that is.If he goes to court and gets a judgment the driver can file BK and walk away and not pay anything. Is this true??

Thank you for any light you can shed on this
