Legal Question in Real Estate Law in Washington

Well agreement

I bought my house from a lady who owned it and the mobile next door, she later sold that mobile to her son. I have been trying to get a well agreement made up. She does not answer any of my calls or emails. The well is on my property, do I have to keep supplying water if they wont agree to sign and record a well agreement? It said something about supplying that mobile with water when I bought my house, but that was before she sold the other one and it did not state anything about paying for electrical and filter costs, or what will happen if something breaks. What can I do legally. Thank you so much.

Re: Well agreement

Did you and the seller do a formal subdivision to divide the property? If so, you would know that you have an agreement regarding the well.

In the absence of a writing, you may not have actually purchased the house. You need to find out. Your escrow documents should reference the well agreement.

If you don't have those documents, you should start by asking the County.

Hope this helps. Elizabeth Powell
