Legal Question in Real Estate Law in Washington

seller hid the truth

Home purchased in Aug of 06. Seller said they had it sprayed for pests just to be on the safe side. Now we find evidence of wood eating pests that have been there for some time as the entire corner of the house has rotten and dusty wood falling out from under the siding. No telling how far it goes up or around the structure as yet. What action can we take if any?

Re: seller hid the truth

You can contact an attorney who does real property cases involving failure to disclose pursuant to Form 17 of the RESPA and sue the sellers.

CPA damages may or may not be available, but this is a big deal. It is worth more than small claims. Call your county Bar and ask for a referral and go talk to an attorney (maybe more than one) and see what they say.

Hope this helps. Elizabeth Powell
