Legal Question in Credit and Debt Law in West Virginia

Medical collections

If you have multiple medical accounts that you are regularly paying $10 a month on, can the company or hospital turn you over to a collection agency? What is the law pertaining to medical collections and payments?

Thank You

Re: Medical collections

A medical debt is a general unsecured debt for which the individual is subject to all collection remedies. A spouse is liable for medical debt even with out signing a promise to pay as is required for other general debts. A custodial parent is liable for the medical expenses of his or her child also without a separate promise. It is commonly believed, incorrectly, that some small payment will prevent other collection efforts. The debt is due when services are performed unless an agreement is made otherwise. Medical expenses often constitute a major part of debt that is discharged in bankruptcy.
