Legal Question in Family Law in West Virginia

Child coustody

My ex-wife and I don not have a formal coustody agreement concerning our 6 year old son. My concern is that she has seperated from her current husband and has taken a job that requires her to spend less and less time with our son. I have had him with me for over a week now and have only been in contact with her once. She did not meet or call to exchange him at the agreed time and did not call until three days later. It has now been three more days and I have not heard from her yet. WEhat do I do.. or what are my options.. I would like him to have his primary residency with me.. but he has two siblings with by his step father. However I believe that if she cannot raise and be with him that i can provide the stability that a home needs. I am married and my wife and I are torn appart by the constant upheval within his home. What can I do ??

Unfortunately I did not get this message until today. If you want to get custody of your son you need to file a petition for custody with the court. It is best to consult a lawyer regarding your options. The sooner the better.
