Legal Question in Civil Litigation in West Virginia

Plaintiff initiated litigation against uf accussing us of fraud for not disclosing alledged pre-existing slip in backyard of house we sold them which was the cause of massive landslide during a declared disaster while simultaniously applying for FEMA funds through SBA declaring there was no pre-existing condition and the landslide was a direct result of the declared disaster. Only one scenario can be correct. Can any legal action be taken against them for knowlingly filing a false claim against us?
