Legal Question in Personal Injury in West Virginia

Dog Bite

me and my husband were walking in a city owned park. a young girl with 2 dogs were approaching us coming from the opposite direction. one dog was on a leash and the other dog wasn't. As she passed us the dog on the leash suddenly bit my husband on his leg tearing teeth mark holes in his pants. It also punched 4 teeth punctures in his leg which penetrated his skin and it bled. I took him to the ER and they treated his bites with dressing and meds. and they gave him antibiotics and pain pills. The next day his leg was bruised from the dog bite. The young girl who was walking the dogs were dog sitting for the owner. Animal control was contacted to see if the dogs shots were up to date. they were up to date. the owner when we called her to inform her of this after they got back from their vacation, was very rude. Saying well I dont have a job and no money to pay your er bill. What would we do in a situation like this. I don't feel we should hav't to pay the bill which is only under 300. dollars. Since it was not my husbands fault. please just inform us if theres anything we can do. thank you, Cindy

Re: Dog Bite

If the owners of the dogs have homeowners or renters insurance, you can make a claim against their policy. If not, you can sue them for up to $5,000 in the magistrate's court.
