My office accepts chapter 13 clients for minimal money down, provided that they have steady employment with enough income to make this type of filing practical for them. Most debtors' attorney fees for chapter 13 cases are paid along with all of the other creditors' claims over a period of five years. During the plan period, debtors have the benefit of protection from creditor garnishments, foreclosures, vehicle repossessions and other collection activities including collector phone calls. In return, however, the debtor promises to pay into the plan via a single periodic wage garnishment, the proceeds of which are split between everyone who is owed money (provided that the creditor filed a valid claim for the money). The payments must be sufficient to pay off a minimum of around five percent of unsecured debt, plus secured obligations (which can also sometimes be reduced). Under the 2005 bankruptcy reform laws, persons who make for than the state median income (currently around $54,000 for a family of four in WI) are more or less forced into chapter 13 rather than chapter seven (which usually does not require any repayment). Exceptions to this income requirement are possible for debtors who make more than this amount but have high secured debt loads. Even debtors with lower income will sometimes want to choose chapter 13 if they are trying to save a house or a car, becuase that chapter can force lenders to accept payments again and even sometimes to return repossessed property. Sorry, no - because I have a very busy Ch. 128 practice, the only bankruptcy cases that I handle for people are Chapter-7 personal bankruptcies.
