Legal Question in Business Law in Wisconsin

tennis lessons

I have been considering giving tennis lessons as a small business that I would do on the side in the city of Milwaukee. Am I allowed to give lessons on public tennis courts for money? Who do I need to talk to in order to get permission? Should I have the students sign a liability form of some sort in case of injury? Are there permits or licenses that I need to obtain (assuming that I would use this as a sole proprietorship or LLC)? I have never owned a business, but am very interested in doing so.

For this type of thing I definitely think that you should speak with an Attorney about the matter. Whether or not there would be a prohibition on giving lessons at a public court is something that would have to be looked into. At first blush I think there could be some issues depending on how you handled it.

Also, you would certainly want to make sure you had properly drafted contracts and waivers for your students. You can never be indemnified against intentional acts or even recklessness, but many people do not realize that it is also difficult to receive protection from negligent acts. The waivers we so often see and sign would never hold up in court.

Finally you would almost certainly want to form an LLC. This would provide you further personal protection of your assets. The tax aspects remain the same- you are taxed as a sole proprietor, but as long as you take the proper steps in making it clear you are an LLC you can obtain some level of protection from that entity.

Good luck to you, but I strongly recommend finding out definitive answers to your questions and ensuring you cross all of your t's and dot all of you i's
