Legal Question in Criminal Law in Wisconsin
Can detectives arrest someone for a crime over a year old
detectives went to my daughters friends home and told him they have a tape of him selling pot a year ago. They said he will be arrested if he does not where a wire and try to get people to buy drugs from him. He does not do this anymore and does not know what to do.

Re: Can detectives arrest someone for a crime over a year old
The State can charge for conduct that is well over a year old. Very generally speaking, the staute of limitations is three or six years depending on whether the offense is alleged as a misdemeanor or felony. Your daughter's friend needs a lawyer. Frequently, detectives will back off once a lawyer is in the picture as it complicates their operation.
