Legal Question in Criminal Law in Wisconsin

we have a homeless person in our church, he wont leave. we have a daycare in our church . he sleeps over night and eats the daycare food. we called the cops and they said they can;t do anything cause it;s a public place? is that true, we put locks on the door but the daycare director lets him in. what can we do????

Getting him some help would seem to be a start, especially for a church. However, another option would be to lock him out, and transform it into a non-public place, at least during closed hours. Then he could be charged with trespass if he refused to leave during closed hours. Running a daycare with unlimited public access by homeless people also presents its own set of issues, since you have a duty to protect the children there while they are in your care. You might need to consider setting up separate secure areas within the church as well. Talk to your attorney about other options, including civil restraining orders, etc., as well as your various liability issues here.
