Legal Question in Family Law in Wisconsin

cancelation of a divorce

my wife filed for a divorce 2 months ago, since then we have reconciled. she called her attorney to stop the action but every time we check on the status of the procedings, it's still going through as a open case in court. how long does it take from the time you stop a divorce action until it's actually stopped? also she paid her attorney a $2,500 retainer as far as my wife knows all that was paid is a filing fee,how much of that money should she get back?

Re: cancelation of a divorce

This is information and NOT legal advice.

Lawyers have different ways of closing down a case. Some let it die a natural death via a dismissal date in the courthouse with no action by the parties. Others file a written stipulation to have it dismissed. Yours decided with the former I believe and that is perfectly fine, it just takes longer. The retainer issue depends on the agreement between the lawyer and client.
