Legal Question in Family Law in Wisconsin

Child custody

My wife suffers from anxiety disorder and depression that greatly affects her relationship with our 5 year old daughter (she loses her temper alot and yells at the child). What would I need to do to show how her behavior is negatively impacting our child? Does this diagnosis of mental illness help me in gaining physical custody of our daughter?

Re: Child custody

Get a therapist to document the detrimental impact your wife is having on child.

Read 767.24 Wis. Statutes.

Re: Child custody

Custody disputes are almost always a nasty, expensive

business with very uncertain outcomes. A pschycological

evaluation of both your wife and the child by a

qualified child psychologist would probably be very

helpful to the court. Whether you would win would

be determined based upon the best interest of the

child. There is more or less of a presumption

in Wisonsin for joint custody, with one parent getting

primary physical placement.
