Legal Question in Real Estate Law in India

My father paid an advance for buying a property by cheque. This was written and signed by the person who took the money on a piece of paper. My father passed away and we are trying to get the money back. The person has been lying everyday and we managed to get about half the money. But it is a mental torture everyday to call him and keep asking for money. He keeps making false promises everyday but fails to keep even one of them. What kind of legal action do we take??
