Legal Question in Family Law in Arizona

divorce in one state and both parties move out of state

My husband and his ex wife were married and divorced in Montana. She moved out of Montana, as did my husband, we live in az, and we just recently located her, she moved to NC, with the minor child. They were divorced in 1992, and we had been unable to locate her, she gave us a wrong name for her husband, I located her through classmates.com. Montana did not know where she was either. Can we ask for the visitation of 4 weeks each summer, and keep in mind that the order says we have to be in 100 miles of mother, or can we ask that she come here, we would as ordered pay the costs.

I would ask her first and she what she says. She might agree and make things really easy. If not you might want to file a motion with the court changing the custody agreement
