Legal Question in Employment Law in Arizona

The small Doctor's office I work for was recently purchased by a corporation. I was given no notice and was told when the Corp. heads came in that I had to "rehire" with the corporation and an "offer letter" would be presented if a position was available to me. My employer has not advised if I am actually "terminated" from my employment with him yet, and when asked I was told that I would be carried as a "temp" employee until a decision was made as to if there is a position available for me. If the offer the corporation makes is not sufficient to support my current situation (i.e. daycare costs, plus living, etc.) I may have to decline. Would I be eligible for unemployment benefits in the state of AZ under this circumstance?

Probably not. As harsh as it is when companies reorganize or are bought out, if you decline the new position you probably will not be eligible for unemployment because you voluntarily severed your employment relationship. Or at least that's the way a court would likely interpret it. If it is a drastic drop in pay you could argue it wasn't comparable and that they in essence forced you to quit. Then maybe you would be eligible for some compensation. Good luck!
