Legal Question in Real Estate Law in Arizona

Warranty Deed mess up!

I was getting a loan to pay off my property. The people selling the property to me had a quit claim deed in her and her husbands name. Her husband passed away in 1996. A she wanted me to get a warranty deed and I did and the title company handled everything at that time. And now I'm tring to get a loan to put a manufatured home on the property and there's a problem with the deed because they never filed a death certificate with the warranty deed. And now it's costing me $20.00 a day for storage on my manufactured home because the women that sold me the property is very sick and can't sign paper work right now. Can I go after the first title company that didn't catch this mess up for the money that it's costing me for my home being in storage because if they would of done their work right, I wouldn't be paying all this extra money out. Can I go after the first title company?

Re: Warranty Deed mess up!

Wouldn't it be cheaper and faster to get a death certificate and record it? Maybe the title company who handled your escrow will do this.

See an attorney if you feel you need to make a claim.

Good luck,
