Legal Question in Credit and Debt Law in California

Auto Loan Deficiency

My car was repossesed and I have a deficiency balance of $15,000. Should I try to arrange payments with the finance company or do I have any other legal options if I go to court?

Re: Auto Loan Deficiency

Thank you for your inquiry.

You always have the right to offer payments as settlement of the amount. You also have the right to defend the lawsuit, and to challenge the amounts that are sought against you. You also have the right to declare bankruptcy on this debt, which may or not be an attractive option, depending on your total financial situation.

I hope this helps, but if you have other questions, want more information, or feel that you need legal representation, please feel free to email me directly at [email protected]. I'm happy to help in any way that I can.
