Legal Question in Credit and Debt Law in California

Breach of contract

I paid a private party $450 for a car transmission that was to be sent to me in a propmt manner but after months, never recieved anything. Before sending them my money, they were very easy to get a hold of on the phone and replied to my emails very promply, but after they recieved my money I tried contacting the party and they were more and more difficult to get a hold of. They never answer the phone or call back to the messages I leave or emails I send, so I had to look up the partie's work number and contact them there. They told me they would soon ship it out, but I asked if I could have my money back instead, to which they agreed. It has since been another 4 months that I still have not been able to contact them or have recieved any money from them. They have not replied to my emails or phone messages about this nor have they contacted me.

They live in Missouri while I live in California, so I don't know what I can do in terms of getting my money back. What can I do about this? Thanks.

Re: Breach of contract

from your facts given, you can take them to small claims court for the $450 breach of contract claim you outlined in your question. if you can tell me where the transaction actually took place, i.e. california or missouri, i can assist you in jurisdiction requirements as well as venue selection for your case. email me this information and also let me know if you would like legal assistance for your small claims court case against this entity, ok.
