Legal Question in Credit and Debt Law in California

Credit agency seeking a default judgment.

I have received a copy of a CIV-100 form by mail from J&L Teamworks (a debt collection agency in Stockton, California) submitted to the S.F. Superior Court for a default judgment on a debt they claim I owe. This debt they're claiming I owe is from a concrete construction company who did some work on our foundation in 2002. The construction claims they never received the final payment for the work completed from the General Contractor and are using the Debt Collector ( who is portraying the construction as a creditor) to get a payment from me. I came to know about this collector when it appeared on my credit report last year. I disputed and it was removed. I also sent a letter requesting proof of the debt and never received a response. I don't think this is legal, but I need to know how to respond and protect myself? The construction company has never filed suit for their claim of final payment nor took to the steps to put a lien on our home. We completed our home in 2003 and all payments were made to the General Contractor.

We would have to review your documents and the filings with the court to help you. It appears that the statute of limitations may have past. If there is a default entered, it will have to be set aside.
