Legal Question in Credit and Debt Law in California

how can they send me to collections?

If I have been paying on a medical bill for the last 4 months every two weeks and not missed one payment and they have cashed every check. How can they send me into collections?

By not sending my checks back or returning my calls, they accepted this payment arrangement.

I even wrote a letter and faxed it over to them and still no fedback.

I can't have this on my credit, I worked very hard to keep it good standing, and thats tuff to do now a days.

There has to be something I can do.

When they kept taking my payments did that not mean they accepted a payment arrangement? they could have called and asked for a higher payment or all at once, but they didn't.

I will be able to pay them off in two weeks and I let them know this in the letter I faxed over.

Please tell me that they can't put this on my credit report.

I can't beleive they would be able to do something like this.

Re: how can they send me to collections?

debt collectors can be very unscrupulous in their attemtps to collect on a debt, and often times violate FDCPA laws in place simply because they feel they can "get away with it" in dealing with the average debtor. if you have been delinquent on the debt at issue, the creditor is within its rights to report that to various credit bureaus. however, if there was a negotiated settlement on the debt at issue, then the creditor should also make that report as well and remove any negative marks associated with the debt upon your final payment. if you would like further assistance in this matter, contact us today.
