Got a summons

I called the Lawyers office who filed the suit and asked them why they are suing me if I've been making payments of $80 every month and they said because they never agreed to that payment plan.Anyway they want me to come up with a 1000 dollar down payment or start paying them $170 a month.They said if I don't call them bk by tomorrow I will have to go to court?Isn't that what the summons is for?What should I do?Wait and go to court and show the judge my receipts and proof that I have been paying them??Hepl!

You must file a responsive pleading to the lawsuit within 30 days of being served with the summons and complaint. If you don't, you will lose all rights to challenge the complaint. The judge won't look at your receipts and hear your statement initially. That will occur down the road.
