denied promotion because of child

Can an employer refuse to promote an employee because they have a child? At my workplace employees have been denied promotion because they have a child, is this legal? Our manager told one employee that it was her choice to have a child and once that child was in school she would then be able to apply for promotions.

Ouch! That is one employer that doesn't know the law!

California has some of the strictest laws against discrimination based on pregnancy, marital and family status, etc. This is called descrimination based on gender.
