Legal Question in Discrimination Law in California

Sexual Discrimination

I was hired one week before my female co-worker for the same position. We were both on the same level with the same duties, selling to the same type of companies. We were also neck-and-neck on our sales quotas - I in fact have surpassed her in sales.

We were both promised promotions. However, she was promoted and I was not.

Now the company has merged and they are getting rid of people on my level while she gets to stay because of her promotion. EVEN THOUGH I have sold more than she has and kept my revenue higher than hers.

My boss treats her with the utmost respect as she is the only female in the office while the rest of the men in the office get no attention. I believe I am a victim of sexual discrimination and I am losing my job because of it.

Please tell me if I have a case?

If you are 100% objective in your assessment of the situation, you may well have a valid claim of sexual discrimination in the workplace (review your employee's handbook). Find a lawyer in your community and be prepared to go into detail about the sales and other objective standards used by your employer for determining promotion. The dates of hire and of promotion will be very important.
