Re: dui charge code is felony or misdemeanor

Vehicle 23152 is driving under the influence of alcohol or a drug or a combination alcohol and drugs. HS 11550 is being under the influence of a controlled substance. Both are misdemeanors. Contact the probation department in the county in which the offenses occurred and request a form to have your conviction expunged. For a small fee they will have it done. It is my recollection that the expungement code section does not apply to driving under the influence charges.
