My son was the passenger in a van that was in an accident and he was seriously injured. He had to have brain surgery. Should I file for medical for him or a claim againt the person who owned the van?

Don't "file" for anything. RETAIN A GOOD PERSONAL INJURY LAWYER, NOW. Shouldn't cost you a dime.

Re: My son was seriously injured in a car accident

You'll get a million responses from attorneys hoping to convince you to let them handle the case, just like this response is intended. The truth is that you will likely need to file suit on his behalf if he is a minor, or he will have to do so if he is an adult. The insurance company(s) represents the driver and the owners, who are both responsible for his damages, but you will find the company(s) difficult to deal with, and you will NOT get as much recovery handling it yourself as would an experienced attorney. If that were not true, there would be no personal injury attorneys in business, because everyone would be happy handling cases themselves. With serious injuries, and substantial doctor bills, get an attorney now, to avoid problems later.
