Legal Question in Family Law in California

I am in an abusive marriage. I really want out and to get a divorce but my he says he will not sign the divorce papers. Is there any way a judge or someome else can make him sign them?

The good news is that you do not need your husband's consent to proceed on a divorce action. Once you serve him the appropriate documents, if he fails to answer them, you can proceed by default. Based upon his conduct and your description, it might be worthwhile to get some protective orders. Please meet with an experienced family law attorney to explore your options..
