Legal Question in Family Law in California

adoption

My husband wants to adopt my daughter. Her biological father has not had any contact with her since she was 14 months old now she is five. Is there any way for us to go about this without having to contact him?

Re: adoption

It depends on who is the legal father. Is the biological father on the birth certificate? Were you married to him at the time of her birth? If so, you must get him to give up his parental rights.

If not, you probably can just go ahead and have him adopt her. You need to seek the specific advice of an adoption attorney; find one by calling your County's Bar Association Lawyer Referral Service. Or, get a referral from a person who has happily used an adoption attorney. Don't use the yellow pages. Worst way to get an attorney.

Good luck.
