Legal Question in Family Law in California

Child Support Payments Start When?

One of my male friends filed for divorce seven years ago and child support ($1000/mo) was agreed upon at that time. He and his wife reconciled during the court hearing and stayed together for another 6 yrs. He has now filed the dissolution of marriage papers again and again they have agreed on child support ($1000/mo). Is he only obligated to pay $1000/mo since the most recent filing?

Re: Child Support Payments Start When?

The general rule is that child support must be paid until it is changed or the child is emancipated. However, in this case he can get a court order stating that he has satisfied the child support for the time the child lived with him. Which I take from the information that you provided was the 6 years that they lived together. Support would start again when they separated. He should modify the support order when the living arrangements of the children change.
