Legal Question in Family Law in California

My daughters father recently passed away, he was married at the time and his spouse is listed on the death certificate. We recenty have found out that his spouse was never divorced from her previous husband. What are the steps to take to insure that my daughter is his only next of kin? He had two pensions which one of them he didnt have a beneficiary, I was told by the company who has the pension that legally it will go to his spouse. Is there anything I can do?

You need to get into probate court immediately with an experienced probate litigation attorney. Do NOT let anything be distributed before you get court orders freezing everything in place while the situation is sorted out by the court.
