Legal Question in Family Law in California

My son will be 18 in August 2010, however he is going off to college in June 2010, where he will be a full time college student attending college on a four year athletic scholarship. My question is can I stop paying his mother child support when he goes off to college since he will no longer be residing with his her?

Once a child turns 18, or if he is still in high school graduates or turns 19 your child support duty ends. Some cases the wage assignment may continue so you need to talk to child support services or file a motion to terminate support.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
