Legal Question in Family Law in California

Disillusioned by the judical system

Recently my husband and I fought for custody for his daughter. Prior to this whole mess we had her about 50% of the time. Needless to say her mother blantaly lied in court and we somehow ended up with 30% custody. Our lawyer missed the hearing w/the court evaluator. Her lawyer was the only one present, since Oct he has not sent us the proper paper work for the child custody order. This woman isn't following the court order for the holidays she dropped our daughter off 3 hours later. She ignores the judges' order and does not care because she know's we don't have any paperwork. Her lawyer will not take/return our calls. After giving us a partial refund our lawyer said he was out of the case and had nothing else to help us with. He briefly mentioned paperwork we could file against her lawyer, something about comtempt of an order? Our lawyer was a flake and neither my husband nor I know where to being to look to do anything about it. Not even sure what it's called when you don't receive your court order paper?! Can't afford another lawyer we have a baby due any day now. Would appericate any feeback I can get to help guide us in the correct direction.

Re: Disillusioned by the judical system

Her attorney is prohibited by law from talking to you while you are represented by an attorney. Set up an appointment with your present attorney and discuss the issues that you have raised in this email. If that does not get results then you should dismiss the attorney, and proceed on your own. It appears that you are not receiving much help from the attorney. After dismissing your attorney, you can contact the local family court and ask about the law clinic. The law clinic should be able to assist you in getting a written order for visitation. The dismissal of your attorney will have to be in writing and signed by the judge. A copy will then have to mailed on the exe's attorney. This will allow her attorney to talk directly with you.
