Legal Question in Civil Litigation in California

Forging a proof of service

I have 4 proof of service documents filed for a civil case that were forged by the defendent in the case. What steps can I take to prosecute? What is the penalty for forging court documents?

Re: Forging a proof of service

If you're claiming you were never served with the summons and complaint, you can file a motion to quash. Obviously, though, you know about the lawsuit, so such an attempt would prove expensive and a waste of time.

If the proofs of service regard something else, you might bring them to the court's attention through a motion, opposition, protective order, etc., depending on the nature of the document(s) purportedly served.
