Legal Question in Immigration Law in California

convert B2 to H1?

I have a degree in management and worked in a hotel (non-franchise but a pretty prominent one in that city) in China for over 4 years and last position at the hotel being the general manager. I came to US two months ago with a B2 visa which expires on 9/30. The owner of an LLC which owns two motels (each less than 60 units) would like to hire me to manage both properties for him.

Am I eligible to apply for--name removed--1?

Thanks.

Re: convert B2 to H1?

You could try but you will have to convice USCIS that hotel manager qualifies as a specialty occupation, and, that you have a bachelors degree or equivalent experience in a relevant field.

The timing would be good however since your B1 will carry you through September (new H1B won't be availabe until October 1st)
